**** HARNARESH SINGH GILL , J. (ORAL) The petitioner is seeking regular bail in FIR No. 199 dated 30.4.2018 registered at Police Station City Hansi, District Hisar under Sections 21(c), 27-A, 61 of Narcotic Drugs and Psychotropic Substances Act, 1985.

Learned counsel for the petitioner states that as per FSL report, the alleged recovery of contraband, effected from the petitioner, does not fall in commercial quantity. He further submits that petitioner is in custody since 30.4.2018 and co-accused Reena, who was involved in the present FIR on the disclosure statement suffered by the petitioner, has been granted the concession of regular bail by this Court vide order dated 14.8.2018. Learned State counsel, on instructions from ASI Amar Singh, submits that challan has been presented and out of 18 prosecution witnesses, only one witness has been examined.

CRM-M No. 48226 of 2019 -2The petitioner is in custody since 30.4.2018. Challan has been presented and the trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
