*** NIDHI GUPTA, J. (ORAL) Challenge in the present petition is to order dated 08.12.2022 passed by learned Additional Principal Judge, Family Court, Karnal in MNT.CIS No. 194 of 2021 titled as 'Om Pati Devi vs. Ram Savroop' whereby petitioner-husband has been directed to pay interim maintenance of Rs.8,000/-p.m. to the respondent-wife alaongwith litigation expenses of Rs.5,500/-.

On 15.12.2022, following order was passed by a Coordinate Bench of this Court:- "The petitioner has assailed the order dated 06.10.2022 passed by the learned Family Court, Karnal vide which interim maintenance @ Rs.8,000/- p.m. has been awarded in favour of the respondent.

Learned counsel for the petitioner contends that the marriage of the petitioner was solemnized with the respondent as back as on 03.06.1971. The respondent has DIVYANSHI 2024.10.03 10:35 I attest to the accuracy and integrity of this document

CRR(F)-1221-2022 (O&M) - 2withdrawn from the society of the petitioner without any sufficient cause and is residing with her children. There is nothing to indicate that during a period of more than 50 years of married life, there was any dispute between the parties. Furthermore, the petitioner is ready and willing to amicably settle the matrimonial dispute.

Notice of motion, subject to the condition that the petitioner shall deposit a sum of Rs.30,000/- on account of litigation expenses in the Registry within a period of two weeks, to be paid to the respondent on her appearance before this Court.

Adjourned to 20.03.2022."

Thereafter on 19.05.2023, none had appeared on behalf of the petitioner and it was noticed by a Coordinate Bench of this Court that as per office report, notice could not be issued to the respondent as litigation expenses of Rs.30,000/- have not been deposited by the petitioner. The said amount of Rs.30,000/- has not been deposited till date. Today also, none has appeared on behalf of the petitioner. Therefore, it can safely be presumed that the petitioner or his counsel is not interested in pursuing the present petition. In view of the above, present petition is dismissed for nonprosecution.
