Petitioners Ramandeep Kaur and Asmi Sharma have filed petition under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 for issuance of direction to respondents No.1 to 4 to conduct fair, proper and speedy investigation in representations dated 17.09.2024, 18.06.2024 and 15.05.2024 (Annexure P-1 to P-3 respectively) in accordance with law against private respondents for causing sexual harassment, outraging modesty, stalking, sending vulgar videos, repeated calls and extending threats to kidnap them and also created atmosphere of fear by firing near their house with further prayer that investigation be carried out by some senior IPS officer and further to protect their life and liberty. 2.
Learned counsel for petitioners in support of this petition has placed on record representations given to the authorities from time to time (Annexure P-1 to P-3), detail of missed calls (Annexure P-4) along with one CD (Annexure P-5). It is argued that police is not taking appropriate action to investigate the matter in controversy. 3.
On the other hand, learned counsel representing UT, Chandigarh has already filed detailed status report. It is pointed out that in pursuance of order passed by Coordinate Bench dated 20.11.2024, mobile phone of petitioners has been sent to Forensic Science Laboratory (FSL) for examination which will take about one and a half month to get the report and to complete investigation. As per status report, there is no specific threat perception to petitioners. However, STPO and SHO are directed to keep constant vigil and provide every necessary assistance immediately to
petitioners in case of emergency in future. It is further alleged that concerned beat box staff and staff of PCR vehicles are also directed to keep regular patrolling in and around the residence of petitioners. 4.
Learned counsel representing respondents No.5 to 7 pointed out that all the allegations levelled by petitioners are without any basis. 5.
I have considered the arguments and have gone through the record. Petitioners have already given representations to police authorities from time to time which are Annexure P-1 to P-3. The matter is being investigated and mobile phone is also sent for forensic examination. It is pointed out that it will take about two months time to complete the investigation on receipt of report from FSL about the said call details. In the light of aforesaid factual position and status report already filed, official respondents are directed to protect life and liberty of petitioners from the hands of respondents No.5 to 9 as and when required considering the threat perception. The official respondents are further directed to complete the investigation within two months from today on the representations filed by petitioners under the supervision of respondent No.3. 6.
Petition is accordingly disposed of. 7.
Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
