RAJESH BHARDWAJ, J.(ORAL) Instant revision petition has been filed impugning the order dated 13.10.2022 vide which learned trial Court has dismissed the application filed by the petitioner under Section 216 Cr.P.C. for addition/alternative charge under Section 302 IPC. After arguing at length, counsel for the petitioner fairly submits that he may be allowed to withdraw this petition with liberty to the petitioner to avail his remedies as available to him before the trial Court. He has submitted that only grievance of the petitioner is that the observations made by the trial Court in the impugned order regarding improvements made by the witnesses may not prejudice the trial. The Court appreciates the apprehension of the petitioner. Petitioner is allowed to withdraw the present petition with liberty aforesaid. However, the learned trial Court is directed to decide the main case without being prejudiced by the observations made in the impugned order.
Dismissed as withdrawn.
