**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present case, sisters of Sh. Gurdev Singh, who was working as a Assistant Lineman with the Punjab State Power Corporation Ltd., are claiming the benefits for which the legal heirs are entitled for after Sh.Gurdev Singh unfortunately died while in service on 24.04.2012. After the death, the sisters who were the only legal heirs, filed a civil suit for the grant of the said benefit, wherein a finding has been recorded that the sisters are only the surviving legal heirs on the day when Sh. Gurdev Singh died as his wife had already died prior to his death. Similarly, is the case of his mother and father, who also died before Sh. Gurdev Singh died on 24.04.2012. With regard to the claim of the benefits, the relief has been left to the department to consider and decide. CWP-32339-2018 -2Counsel for the petitioners states that as the petitioners have already been held to be the only surviving legal heirs of late Sh. Gurdev Singh, they have served respondents with a legal notice on 16.07.2018 (Annexure P-6), which is still pending consideration with the respondents and the petitioners will be satisfied, at this stage, in case a time bound direction is given to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioners, the respondents are directed to decide the legal notice dated 16.07.2018 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioners are entitled for any monetary benefit, the same shall also be released to them within a period of next three months.

Present writ petition stands disposed of.
