of 2023 Apprehending his arrest in FIR No.125, dated 25.09.2023, registered for offences punishable under Sections 21 of the NDPS Act, 1985 (later on added Section 29 of the NDPS Act) at Police Station Sadar Jalalabad, District Fazilka, the petitioner has preferred this petition under Section 438 Cr.P.C. seeking pre-arrest bail.

Ld. Counsel for the petitioner inter alia submits that the petitioner has been nominated merely on the basis of disclosure made by co-accused Gurpreet Singh who was apprehended along with 100 grams of heroin and the petitioner has clean antecedents. Issue notice of motion, returnable for 08.02.2024. Mr. Tarun Aggarwal, Sr. DAG, Punjab appears and accepts notice on behalf of the respondent/State.

In the meantime, in the event of arrest, the petitioner shall be released on interim bail subject to his furnishing personal and surety bonds to the satisfaction of the Arresting Officer/Investigating Officer. As and when called, the petitioner shall join the investigation. He shall abide by the conditions enumerated under Section 438(2) of the Cr.P.C.
