* SUBHAS MEHLA %#&'( The instant revision petition has been filed by the petitioner for setting aside order dated 22.08.2025 passed by the learned Sessions Judge, (Fast Track Court for trial of offences under NDPS Act), Kurukshetra whereby the application moved by the petitioner seeking preservation of CCTV footage of Pabnawa Toll Plaza situtated on National Highway 152-D near Pehowa has been dismissed.

In pursunace to the last order passed by this Court, i.e., 28.08.2025, learned counsel for the petitioner contends that he wants that the CCTV footage of wide Line no. 1 between 10.00 p.m. to 11.00 p.m. on 28.07.2025 is to be preserved so that the accused can lead evidence in his defence at an appropriate stage.

On the other hand, learned State counsel, appearing on advance SEEMA 2025.09.02 18:18 I attest to the accuracy and integrity of this document
notice, submitted that previously the application was vague and no specific detail has been given by the petitioner and now when he has given the specific details, he has no objection to the prayer made. 4.

Keeping in view the facts that the petitioner wants to preserve the evidence which he can lead in his defence and it is the cardinal principle of law that justice should not only be done but must be seen to be done. Accordingly, the impugned order dated 22.08.2025 passed by the trial Court is modified to the extent that trial Court is directed to pass an appropriate order for preservation of CCTV footage of wide Line no. 1 between 10.00 p.m. to 11.00 p.m. on 28.07.2025 of Toll Plaza situated near Pabnawa, Pehowa.

Petition is disposed of.
