-.- KARAMJIT SINGH , J. (Oral) Prayer is for grant of anticipatory bail in case having FIR No.290 dated 11.10.2022 registered under Sections 323, 324, 326, 148, 149, 120-B IPC at Police Station Rama Mandi, District Police Commissionerate Jalandhar.
As per the allegations recorded in the FIR, on 6.10.2022 at about 12:42 am, complainant-Aryan Sharma was going to see his grand father and in the meantime, 10 boys who were armed with different weapons GAURAV SOROT 2023.02.24 12:40 I attest to the accuracy and authenticity of this order, judgment and documents.
( 2 ) CRM-M-55915-2022 encircled him and they attacked and caused injuries to him and even the petitioner was named in the FIR, who was armed with baseball bat. Counsel for the petitioner submits that only simple injuries are attributed to the petitioner that too with blunt weapon and the petitioner has joined investigation with the police by virtue of previous order of interim bail passed by this Court.
The present petition is opposed by the counsel for the complainant who submits that the petitioner was member of unlawful assembly and one of the member of the said unlawful assembly attributed grievous injury with sharp edged weapon to complainant-Aryan Sharma. State counsel on instructions from ASI Manjit Singh submits that the petitioner has joined investigation and got effected the recovery of baseball bat. State counsel further submits that the petitioner is not required by the police for further investigation or for custodial interrogation. In view of the above as the petitioner is attributed only simple injury and recovery has already been effected, without commenting on the merits of the case, the present petition is hereby allowed and order dated 2.12.2022 is hereby made absolute.
