The petitioner has preferred that the present petition under Section 438 of the Code of Criminal Procedure, 1973 for a direction to the arresting officer to release the petitioner on bail forthwith in the event of his arrest in case FIR No.24, dated 07.09.2023 registered under Sections 406 and 420 of the Indian Penal Code, 1860 at Police Station NRI, District SAS Nagar, Punjab.

While granting interim protection to the petitioner, this Court passed the following order on 20.10.2023:- "

Learned counsel for the petitioner submitted that the dispute between the petitioner and the complainant was only a financial dispute pertaining to a plot and now the matter has since been compromised between the parties vide Annexure P-2 and nothing is due in this regard.

In the meantime, the petitioner is directed to join the investigation and to co-operate fully with the investigation process and on his doing so, the petitioner be released on interim bail, subject to his furnishing personal bonds and surety to the satisfaction of the Arresting/Investigating Officer. However, the petitioner shall continue to join the investigation as and when called upon to do so and shall abide by the conditions as provided under Section 438(2) Cr.P.C." 3.

On 31.01.2024, the case was adjourned on the request of learned counsel for the petitioner and interim order was ordered to be continued till the next date of hearing.

Learned State counsel, on instructions from ASI Gursewak Ram, submits that the petitioner has not joined the investigation in compliance of order dated 20.10.2023. He further submits that there are 10 more cases registered against the petitioner. 5.

In view of the above, no ground for anticipatory bail is made out and the present petition is dismissed accordingly. 6.
