(ORAL) Prayer in the present petition is for grant of interim regular bail to the petitioner in a case FIR No.148, dated 20.10.2023, under Sections 302, 404, 341, 148 and 149 of the Indian Penal Code, 1860, and Sections 25 and 27 of the Arms Act, 1959, registered at Police Station Kot Ise Khan, District Moga, on account of death of his daughter on 04.10.2024. In compliance of the order dated 07.10.2024 passed by the Coordinate Bench, learned State counsel, on instructions from ASI Surinder Singh, has verified the factum of death of the petitioner's daughter and submits that the daughter of the petitioner has unfortunately expired on 04.10.2024 and her bhog ceremony is fixed for 14.10.2024. CRM-M-50796-2024 (O&M) -2Having heard learned counsel for the parties and perused the record.

It transpires that on 04.10.2024, the daughter of the petitioner namely Simranjeet Kaur has passed away and the petitioner is facing serious emotional distress due to sudden demise of his daughter and petitioner being father has to perform religious ceremony and last rites of his daughter and petitioner being incarcerated could not attend the cremation of his daughter. Keeping in view the resolution passed by the Panchayat and also the verification of the police authorities, the present petition is allowed and the petitioner is granted interim bail for three weeks from 11.10.2024 and he is directed to surrender on 02.11.2024 on/or before 05:00 P.M. before the Jail Authorities concerned.
