ARVIND SINGH SANGWAN, J. (Oral) The petitioners pray for grant of anticipatory bail in FIR No.146 dated 13.08.2018, registered under Sections 341, 324, 323, 148, 149 of the Indian Penal Code (in short 'IPC') (Section 326 IPC added vide DDR No.24 dated 29.11.2018) at Police Station Sardulgarh, District Mansa.

The operative part of the order dated 18.12.2018, vide which interim anticipatory bail has been granted to the petitioners, is reproduced as under:- "....Learned counsel for the petitioners submits that it is a case of version and cross-version and in the crossversion, FIR under Section 452 IPC was registered against the complainant's side. It is further submitted that even from the petitioners' side, one Baljeet Singh has suffered injuries and relies upon his MLR (Annexure P-1 colly.). Learned counsel further submits that the injuries MOHD YAKUB 2019.03.14 16:29 I attest to the accuracy and integrity of this document

CRM-M No.55980 of 2018 attributed to the petitioners are on non-vital parts of the body and the injury invoking offence punishable under Section 326 IPC is attributed to aforesaid Baljeet Singh. Notice of motion for 14.03.2019...."

Counsel for the petitioners has submitted that, in pursuance to the order dated 18.12.2018, the petitioners have appeared before the Investigating Officer and have joined the investigation. Counsel for the State, on instructions from HC Harjinder Singh, has not disputed the aforesaid fact and submits that the petitioners are no more required for further investigation. In view of the above, this petition is allowed and the interim bail granted to the petitioners vide order dated 18.12.2018 is made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C.
