SANDEEP MOUDGIL, J (ORAL) Prayer in the instant petition filed under Section 482 of BNSS is for grant of anticipatory bail in cross case registered vide GD No.22 dated 13.05.2024 under Sections 326,324,452,148,149 IPC recorded in case FIR No.0054 dated 01.05.2024 under Sections 326,324,148,149 IPC registered at P.S Chatiwind, District Amritsar.
This Court vide order dated 10.10.2024, while issuing notice of motion, granted the concession of interim bail to the petitioners, subject to their joining the investigation.
Learned counsel for the petitioners submits that in pursuance to the order dated 10.10.2024, the petitioners have joined the investigation. Upon a specific query being put as to whether custodial interrogation of the petitioner is required, learned State counsel submits that nothing is to be recovered and on that count, this Court can easily infer that dismissal of the petition would be unjust and infringing the right of life and liberty of the petitioners as enshrined under Article 21 of the Constitution. In view of the above, the order dated 10.10.2024 is made absolute. Accordingly, the present petition is disposed of. ( SANDEEP MOUDGIL ) JUDGE 13.01.2025 manoj
