***** ARCHANA PURI, J. (Oral) As observed in the previous order, despite service, the respondent did not make appearance, on that date. Even today, he has not made appearance. As such, respondent is proceeded against ex parte. Counsel for the applicant heard.
The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act i.e. HMA/43/2025 titled 'Baljinder Singh v/s Komal Rani', filed by the respondent-husband, pending in the Family Court, Fatehgarh Sahib and she seeks transfer of the same to the Court of competent jurisdiction at Panchkula.
At the very outset, it is submitted by the counsel for the applicant that the marriage between the parties to the lis, had taken place on 19.01.2024, but no child was born from the said wedlock. TA-1096-2025 applicant is not having any source of earning and is dependent upon her parental family. Even, the applicant has got lodged an FIR 0074 dated 20.06.2025 under Section 798-A IPC, which is pending investigation and also she has filed the petition under Section 125 Cr.P.C., as well as the petition under the Protection of Women from Domestic Violence Act, which are pending in the Courts at Panchkula and the respondent is pursuing both the said petitions. The distance between the two places is stated to be about 75 kms.
Considering the submissions aforesaid, more particularly, taking note of the three other litigation, arising from the matrimonial dispute, already pending in the courts at Panchkula and above it taking into consderation the fact of the respondent having not come forward to resist the transfer application, the same is allowed and the petition under Section 9 of the Hindu Marriage Act i.e. HMA/43/2025 titled 'Baljinder Singh v/s Komal Rani', filed by the respondent-husband, stands transferred from the Family Court, Fatehgarh Sahib, to the Court of competent jurisdiction at Panchkula. The requisite record of the aforesaid case be sent by the Family Court, Fatehgarh Sahib, to the District and Sessions Judge, Panchkula. Learned District and Sessions Judge, Panchkula, shall assign the said petition to the Family Court, Panchkula. Even, the parties are directed to appear before the Family Court, Panchkula, within a period of one month from today onwards.
