The learned counsel for the petitioner submits that the conclusive, and, binding verdict of eviction passed in the year 2013, has yet remained unexecuted, through the decree holder concerned, preferring an application for execution thereof, thus before the learned Executing Court concerned.

However, the learned State counsel contests the above submission, and, submits, that the appeals against the verdict of eviction (Annexures P-1 and P-2), have been preferred by the aggrieved before the appellate authority concerned. He further submits that the said statutory appeals bearing Nos. 487 of 2023 and 497 of 2023 are listed on 22.11.2023. 3.

Therefore, the learned counsel for the petitioner cannot, with any vigour, submit before this Court, that the said verdict of eviction has acquired any conclusivity, and, finality, nor he can pray before this Court, that a mandamus be passed upon the decree holder concerned, to forthwith GURPREET SINGH 2023.11.08 15:22 I attest to the accuracy and authenticity of this order/judgement Chandigarh

CWP No. 24332 of 2023 -22023:PHHC:141647-DB institute an execution petition before the learned Executing Court concerned, for thereby ensuring the completest, and, efficacious execution being made of the annexures (supra).
