BHARDWAJ, J,(ORAL) Prayer made in the present petition is for seeking direction to respondents no.1 to 4 to release the petitioner on parole for six hours between 8:00 AM to 2:00 PM on 29.10.2023 under Section 3(1)(d) of the Punjab Good Conduct Prisoners Temporary Release Act, 1962 to facilitate the petitioner to attend the marriage of his niece. 2.

Learned Additional Public Prosecutor,
informs this Court that the issue has already been considered by the competent authority i.e., the Additional Superintendent, Model Jail, UT, Chandigarh and that request has been declined since there is no provision under the Punjab Jail DHARAM VIR 2023.10.23 18:14 I attest to the accuracy and authenticity of this order/judgement.
CRWP-10462-2023 -2Manual or any rule vide which a convicted prisoner can be released to attend the marriage of relatives or friends.

It is also prescribed that 'niece' is not defined in the definition of a family member as per the Act of 1962 and rules notified thereunder.

The above-said order bearing Memo No.10121/UT/SJ, CHD, dated 18.10.2023, is not a subject matter of challenge in the present petition nor are the provision of the Punjab Good Conduct Prisoners Temporary Release Act, 1962.

In view of the same, the present petition is dismissed at this stage, with liberty to the petitioner to file an appropriate petition, if so advised.
