*** HARSIMRAN SINGH SETHI , J. (ORAL) The claim in the present writ petition is that petitioner was senior to one Sh. Paras Ram right from the date of joining as a Junior Draftsman, but Sh. Paras Ram was granted the basic pay, which was higher than the petitioner, though, seniority of the petitioner was at Sr.No.141 and that of Sh. Paras Ram was 196.

Counsel for the petitioner states that there was no valid justification with the respondents to grant a junior person the higher basic pay than the petitioner and as the said Sh. Paras Ram was granted a higher basic pay than the petitioner, petitioner being senior employee, was entitled for stepping up of his pay equivalent to his junior Sh. Paras Ram. The prayer of the petitioner is for directing the respondents to step up his pay equivalent to Sh. Paras Ram and grant him the arrears. CWP-32965-2019 -2Counsel for the petitioner further states that for the relief, which has been sought in the present writ petition, petitioner has served the respondents with a legal notice dated 09.05.2019 (Annexure P-6), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 09.05.2019 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
