The prayer in the present petition is for quashing of the order dated 03.07.2024 (Annexure P-4), passed in case bearing No. SC-258-2017 arising out of FIR No. 108 dated 01.12.2016 registered under Sections 307, 337, 338 and 506 IPC at Police Station Sudhar, Ludhiana. 2.
Vide order dated 10.10.2024, the following order was passed, which is reproduced as under:
Learned counsel appearing on behalf of the petitioner inter alia contends that the bail order passed in favour of the petitioner has been cancelled on account of failure of the petitioner to appear on the date fixed. He contends that his bail bonds have been ordered to be forfeited to the State and nonbailable warrants have been issued. It is submitted that the matter was fixed for prosecution evidence, however, none of the witnesses appeared and as such no prejudice could have been caused to the case of the prosecution. CRM-M-50868-2024 is fixed before the trial Court on 11.10.2024 and the petitioner undertakes to appear before the trial Court on the said date. Notice of motion.
Mr. Ajaib Singh, Addl. A.G.Punjab appears and accepts notice on behalf of respondent-State. In the meanwhile, in the event of the petitioner appearing before the trial Court on the date fixed i.e. 11.10.2024, he shall be admitted to interim bail to the satisfaction of the trial Court.
To come up on 11.11.2024 for further consideration. 3.
Learned State counsel submits that the petitioner joined the proceedings on 11.10.2024 and, as per instructions, the petitioner had surrendered before the learned trial Court on the said date and was admitted to the concession of bail.

In light of the submissions advanced by counsel for the petitioner, the order dated 03.07.2024 (Annexure P-4), passed in case bearing No. SC-258-2017 arising out of FIR No. 108 dated 01.12.2016 registered under Sections 307, 337, 338 and 506 IPC at Police Station Sudhar, Ludhiana, is hereby quashed.
