Petitioner - Pritpal Singh has filed petition under Section 482 of Bharatiya Nagarik Suraksha Sanhita, 2023 for grant of anticipatory bail in FIR No.90 dated 03.09.2024, under Sections 75, 76 of BNS, 2023 and Section 8 of Protection of Children from Sexual Offences Act, 2012, registered at Police Station Sadar Patti, District Tarn Taran. 2.

As per facts of the case, prosecutrix who is a minor girl age 15 years, gave her statement that she is a student of 10th class studying in Government Senior Secondary School, Sabhra. On 28.08.2024, she was feeling unwell and was having palpitation. She along with her parents had gone to see doctor Pritpal alias Preet who is running a shop. At about 4/5:00 PM in the evening when she went to the doctor she was told to lie down behind the curtain and her parents were sitting outside. Doctor Pritpal lifted her t-shirt and without her consent started touching her breast on the pretext

 of medical checkup. He did obscene act. She hurriedly stood up and after coming out narrated the incident to her parents. Said doctor Pritpal apologized from his father. Due to humiliation, they did not disclose about this incident to any one. Ultimately, the matter was reported to the police. 3.

Learned counsel for petitioner pointed out that he is falsely implicated in this case. He is a reputed BAMS doctor and is in this profession for the last four years. Father of prosecutrix took loan of Rs.77,000/- and out of which he returned Rs.23,500/-. These false allegations are levelled against him when he asked him to return his money. He has annexed copies of UPI transactions (Annexure P-2). Even otherwise, in pursuance of order dated 16.10.2024 he has already joined the investigation and he is still ready to abide by the terms of bail order. 4.

Learned counsel representing State filed status report. It is pointed out that present petitioner is specifically named and specific role is attributed to him. Allegations are serious. However, it is confirmed that petitioner has already joined investigation and he is not required for any other purpose.

I have considered the arguments and have gone through the record. Perusal of file shows that petitioner was granted interim bail by Coordinate Bench by passing detailed order dated 16.10.2024 and in pursuance of the same, he has already joined the investigation. Learned counsel representing State confirmed that petitioner is not required for any other purpose.  6.

In light of this, no purpose would be served by sending the petitioner behind the bars. Therefore, without going on merits of the case,

 interim bail already granted in favour of petitioner - Pritpal Singh vide order dated 16.10.2024 stands confirmed, subject to the conditions as enshrined under Section 482(2) of BNSS. 7.

Petition is accordingly allowed. 8.

Pending miscellaneous application(s), if any, stand disposed of accordingly as well.
