IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

CWP-27786-2022 (O&M) Date of Decision: 05.12.2022 Takdeer .....Petitioner

Versus

Haryana Staff Selection Commission and others .....Respondents CORAM: HON'BLE MR. JUSTICE ARUN MONGA

Present:

Mr. Bhupinder Malik, Advocate for the petitioner.

Mr. Pankaj Middha, Addl.A.G., Haryana.

***** ARUN MONGA, J. (ORAL) Petition herein, inter alia, is for issuance of a writ in the nature of Certiorari for setting aside result dated 17.11.2022 (Annexure P-13) and a detailed result dated 18.11.2022 (Annexure P-14) whereby the petitioner has been shown as "not eligible" on the ground that qua the General category since the petitioner being General category candidate has secured 52 marks and the cut-off given for the same category is 35 marks. Petitioner was held ineligible on account of not having the requisite minimum work experience. 2.

My attention has been drawn to the eligibility conditions for the post of Operators which inter alia envisages that persons applying should have ITI Certificate in Mechanical Trade along with 5 years experience in relevant field. 3.

On advance service, the learned State counsel appears and on a Court query, he is unable to effectively make a statement as the relevant field as to that of only Mechanical Trade or any other ancillary or incidental field connected therewith and submits that a decision will be taken by the competent authority, either way, on the pending representation of the petitioner by passing a speaking order.

CWP-27786-2022 (O&M) -24.

At this stage, learned counsel for the petitioner also seeks decision on the pending representation, as suggested by learned Statecounsel. 5.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

6.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the pending representation dated 24.11.2022 (Annexure P-15) of the petitioner and pass an administrative order, giving specific reasons thereof, in accordance with law. 7.

Let the needful be done as expeditiously as possible but in any case not later than 6 weeks.

8.

Till the decision on the representation is taken, one post in question in the category petitioner had applied, shall not be filled up. (ARUN MONGA) JUDGE December 05, 2022 ashish Whether speaking/reasoned:
