Through the instant writ petition, a prayer has been made for issuance of directions upon the respondent No.1 to release the file pertaining to partition proceedings to the A.C. Ist Grade, Amloh. 2.

On the last date of hearing, i.e. 29.08.2025, this Court had passed the following order:- "At the outset, this Court, without delving into the merits of the case at hand, directs the learned State counsel to have apt instructions, and file a specific affidavit, as to how, the SubDivisional Magistrate, in the capacity of the Presiding Officer, Maintenance Tribunal, can withhold the records pertaining to the partition proceedings.

Adjourned to 02.09.2025.

It is made clear that in case of non-compliance of the direction (supra), the SDM concerned shall cause his/her personal appearance, on the next date of hearing." 3.

In deference to the directions enclosed in the hereinabove DEVINDER YADAV 2025.09.04 09:13 I attest to the accuracy and authenticity of this order/judgment

CWP-25438-2025 extracted order, today the learned State counsel has filed a reply dated 01.09.2025, on affidavit of Mr. Chetan Bunger, Sub Divisional Magistrate, Amloh, District Fatehgarh Sahib, which is taken on record. This reply reveals that the apposite record has already been transmitted to the authority concerned.

In view of the above, no further direction is required to be passed, and the instant writ petition is closed. The A.C. Ist Grade, Amloh, shall proceed with the partition proceedings in accordance with law. 5.

Disposed of accordingly.
