Prayer in this writ petition filed under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing respondent No.3 to consider the recommendations of respondent No.4 made vide his letter dated 04/04/2024 (Annexure P/1) and grant deemed date of promotion to the petitioner as SSA with all consequential benefits of pay, fixation/refixation of pay, arrears of pay and interest therein from 29/01/2013 (Annexures P/2). Further prayer has been made to direct the respondents to prepare/amend the seniority list of SSAs after assessing the petitioner's proper place therein in accordance with the date of grant of deemed date of promotion as SSA to the petitioner.

Learned counsel for the petitioner submits that he would be satisfied if the representation dated 05.03.2024 (Annexure P-18) of the petitioner is decided by respondent No.1 by passing a speaking order in a time bound manner.

Learned counsel for the respondents, appearing on advance notice, submits that she has no objection, in case a direction is issued to respondent No.1 for time-bound consideration and decision of the representation dated 05.03.2024 of the petitioner by passing a speaking order.

Therefore, in view of the limited prayer made by learned counsel for the petitioner, the respondent No.1 is directed to consider the representation dated 05.03.2024 (Annexure P-18) of the petitioner and pass a speaking order, after affording an opportunity of hearing to the petitioner, within a period of 03 months from the date of receiving a certified copy of this order. Further, the decision taken thereof shall be conveyed to the petitioner. Needless to say, if the petitioner is found entitled to the relief sought, the same shall be granted forthwith by respondent No.1.
