This order shall dispose of the above mentioned two petitions wherein petitioners Kulwinder Singh and Roop Singh, are seeking
CRM-M-48445-2019 & CRM-M-33969- 2020 (O&M) - 2 - grant of anticipatory bail in a case registered vide FIR No.130, dated 8.8.2018, Police Station Division No.2, District Luhdiana, under Section 379-B, 34 IPC.

The FIR was registered at the instance of Surender Pal wherein it is alleged that on 6.8.2018 he was on his way to Jamalpur on an auto rickshaw in which four other passengers were sitting and who starting playing 'Gitti Dana'. It is alleged that the said persons insisted upon the complainant to join them in the game but the complainant refused. It is alleged that when they reached near Street No.6 on Brown Road then the said persons forcibly snatched a gold ring weighing 7 grams worn by the complainant and also snatched an amount of `1,000/- from him.

Pursuant to interim directions, the petitioners are stated to have joined investigation and are not required for any custodial interrogation.

Having regard to the facts and circumstances of the case and the amount involved in the present case, the petitions are accepted and the interim directions issued vide order dated 29.11.2019 passed in CRM-M-48445-2020 and order dated 23.10.2020 in CRM-M-339692020 are hereby made absolute subject to the condition that the petitioners shall appear and join investigation as and when called upon to do so and cooperate with the Investigating Officer and shall abide by the conditions as provided under Section 438 (2) Cr.P.C.

Since, the learned State counsel has informed that in the present case offence under Section 201 IPC has also been added later on, it is directed that the aforesaid order shall enure offence under Section 201 IPC as well.
