(ORAL) Prayer in the instant petition under Section 438 Cr.P.C. has been made for grant of anticipatory bail to the petitioner, in case, FIR No.18 dated 22.03.2018, registered under Sections 406, 420 IPC and Section 24 of Immigration Act, 1983, Police Station Hajipur, District Hoshiarpur (P-1).
According to the prosecution, in the year 2016, the petitioner along with his accomplice Narinder Pal cheated two complainants and two others for `3.5 lakhs on the false pretext of sending them abroad on working Visa to Sharjah and were sent to Sharjah, but on forged Visa. Therefore, the complainants were deported from Sharjah to India. Learned counsel contends that petitioner is innocent. CRM-M-57339 of 2018 --2-- cheated the complainants. The petitioner received only `1,65,000/- in his bank account, which he is ready to return. On the other hand, learned State counsel opposing the above submissions, contends that there are total 4 complainants, who have given statements that some part of the amount was transferred by them in the account of petitioner. The petitioner is active partner with his accomplice Narender Pal.
Considering the seriousness of allegations, this Court is not inclined to grant anticipatory bail to the petitioner. Dismissed.
