(ORAL) In the present case, the petitioner is claiming the step of his pay equivalent to his junior Sohan Singh, who belongs to reserve category and got accelerated promotion by way of reservation. Counsel for the petitioner states that the petitioner was also promoted as a Junior Engineer (F) on 31.03.1990 when Sh. Sohan Singh was also working on the said post and therefore, he is entitled for the step of his pay equivalent to his junior as per instructions dated 27.11.2006 (Annexure P-2), instructions dated 05.03.2009 (Annexure P-3) and instructions dated 18.12.2013 (Annexure P-5). Counsel for the petitioner relies upon a judgment of Co-ordinate Bench of this Court passed in CWP No.17280 of 2011, decided on 07.08.2012, in support of the claim of the petitioner. CWP-37705-2018 -2Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has served respondents with a legal notice on 27.03.2018 (Annexure P-6), which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice. In view of the above request, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 27.03.2018 (Annexure P-6) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next three months.

Present writ petition stands disposed of.
