**** JASJIT SINGH BEDI, J. (Oral) On 31.10.2023, the following order was passed:- "The prayer in the present petition under Section 482 Cr.PC is for quashing of the order dated 24.05.2023 (Annexure P6) in FIR No.97 dated 28.10.2017 under Sections 341, 323, 506, 148 and 149 IPC registered at Police Station City Kotwali, Nabha whereby the petitioner has been declared a proclaimed person. The learned counsel for the petitioner contends that on account of the registration of the another FIR, the petitioner was unable to appear before the Trial Court leading to the passing of the impugned order (Annexure P-6). He further contends that the present FIR is an outcome of a family dispute between the petitioner and his cousin brother and even otherwise, the impugned order has been passed in violation of the mandatory provisions of Section 82 Cr.P.C. He states that the petitioner is ready and willing to join the proceedings once again. Notice of motion for 17.11.2023.

In the meanwhile, the petitioner is directed to surrender before the Trial Court within a period of one week from today and subject to a deposit of Rs.50,000/- as costs with the Shree Shiv Kanwar Mahasangh Charitable Trust (Regd.), #36A, Near Gugga Marhi Mandir, Maheshpur, Sector 21, Panchkula, Haryana, Bank Account No.55020100001119 IFSC Code BARB0MDCPAN (0Zero) Bank of Baroda, Swastik Vihar, Panchkula, he shall be admitted to interim bail to the satisfaction of the trial Court. The learned counsel for the petitioner shall produce the receipt regarding deposit of Rs.50,000/- with the aforesaid Trust as well as a copy of the order granting interim bail to the petitioner on the next date of hearing." Thereafter on 17.11.2023, the following order was passed:- "The petitioner who has appeared in person prays for one more opportunity to comply with the order dated 31.10.2023. On his request, one opportunity is granted to him to surrender before the Trial Court within one week from today in terms of the order dated 31.10.2023."

CRM-M-54464-2023 -2On 01.12.2023, the following order was passed:- "On 31.10.2023, the peƟƟoner was directed to surrender before the Trial Court within a period of one week subject to his deposit of Rs.50,000/- as costs with the Shree Shiv Kanwar Mahasangh Charitable Trust (Regd.), #36A, Near Gugga Marhi Mandir, Maheshpur, Sector 21, Panchkula.

The peƟƟoner has been admiƩed to interim bail vide order dated 21.11.2023 passed by the Judicial Magistrate Ist Class, Nabha (Mark 'A'). However, in view of the poor condiƟon of the peƟƟoner, the amount of Rs.50,000/- to be deposited by him is ordered to be reduced to Rs.25,000/- to be deposited with above menƟoned Charitable Trust.

Adjourned to 08.12.2023.

In the meanƟme, the peƟƟoner is directed to placed on record the receipt of Rs.25,000/- deposited with the Charitable Trust."

On 08.12.2023, the following order was passed:- "The peƟƟoner has deposited a sum of Rs.10,000/- and placed on record cerƟficate issued by Bank of Baroda issued in that regard, which is taken on record.

List on 23.01.2024.

Remaining amount of Rs.15,000/- be deposited within 02 weeks from today.

In pursuance to the afore-mentioned orders, the petitioner has been released and has since been admitted to the interim bail vide order dated 21.11.2023.

In compliance of the last order dated 08.12.2023 passed by this Court, the petitioner has already deposited remaining amount of Rs.15,000/-.

In view of the above, no further orders are required to be passed by this Court.

It is expected that the petitioner shall not absent himself from trial without sufficient cause.

Disposed of.
