G.S.SANDHAWALIA, J. (Oral) The present review application has been filed for review of the order dated 26.04.2017 whereby, the revision petition filed by the landlord seeking amendment in ejectment application was dismissed and the order of the Rent Controller dated 09.08.2016 was upheld who had dismissed the application filed for amendment.

The order was dictated in open Court. However, counsel has submitted that he restricts his claim only to this aspect that on account of the observations made in the said order, the Rent Controller might be prejudiced as such while deciding the eviction petition at the final stage. Therefore, he has restricted his claim to this extent that the observations should not finally affect the proceedings at the final stage. Notice in the application.

Needless to say that the order is only dealing with the fact whether the impugned order was well justified or not and in such circumstances, certain findings have been recorded, which obviously will not prejudice the Rent Controller while taking a decision on the merits of the case on the basis of the pleadings and the evidence which has come on record.
