H. S. Madaan, J. (Oral) Counsel for the applicant states that since in terms of Section 9 of the Guardians and Wards Act, 1890, only the Court at Rohtak, has got jurisdiction to entertain and try the petition and it was wrongly filed by the respondent in the Court at Jind, therefore, at the first instance, he would approach District Judge, Jind, seeking return of the petition for being presented to the Court having jurisdiction at Rohtak and he be permitted to withdraw the present application. Allowed.
Dismissed as withdrawn.
As requested by counsel for the applicant, the applicant would be at liberty to approach this Court again, if some adverse order is passed by the trial Court on the application moved by the applicant for return of the petition on account of lack of territorial jurisdiction.
