IN THE HIGH COURT OF PUNJAB AND HARYANA AT CHANDIGARH

CRM-M-48622-2019 (O&M) Decided on : 04.08.2020 Ramesh @ Tinu . . . Petitioner(s)

Versus

State of Haryana . . . Respondent(s) CORAM: HON'BLE MRS. JUSTICE MANJARI NEHRU KAUL PRESENT: Mr. Gautam Dutt, Advocate, for the petitioner(s). Mr. Manish Dadwal, AAG, Haryana assisted by ASI Karambir.

**** MANJARI NEHRU KAUL, J. (Oral) Due to the outbreak of pandemic COVID-19, the instant case is being taken up for hearing through video conferencing. This present petition has been filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No. 388, dated 26.11.2018, under Section 302 IPC, registered at P.S. Kherki Daula, District Gurugram. Learned counsel for the petitioner inter alia contends that the petitioner has been falsely implicated in the FIR in question and has been made scape goat by the complainant himself, who was embroiled in a proper dispute with his brother deceased - Vikram. He further contends that the petitioner has been in custody since 28th November, 2018 and the trial is unlikely to conclude in the near future. Per contra, learned State counsel while opposing the prayer for grant of regular bail to the petitioner, on instructions from ASI Karambir, has apprised this Court that the prosecution evidence stands concluded and the case is now fixed for final arguments for 14th August, 2018.

In the circumstances, no ground for grant of regular bail to the petitioner is made out.

Dismissed.
