(ORAL) On 5.12.2022, following order was passed:- "The petitioner, through instant petition under Section 482 Cr.P.C. is seeking issuance of directions to official respondent Nos. 2 and 3 to decide expeditiously report sent by investigating officer for approval after investigation in Rapat No. 16 dated 9.10.2022 (Annexure P-4) under Sections 326, 427, 34 IPC, registered at Police Station Sadar, Patti, District Tarn Taran. Learned counsel for the petitioner, inter alia, contends that police has already prepared Rapat No. 9.10.2022 (Annexure P-4) whereby investigating officer has proposed to cancel Case No. 105 dated 16.7.2022, Cross Rapat No. 35 dated 19.7.

2022 under Sections 326, 427, 34 IPC, registered at Police Station Sadar, Patti, District Tarn Taran. The petitioner is a Government Employee and working as Senior Industrial Promotion Officer in the District Industry Centre, Ferozepur. The petitioner cannot get promotion and even three is threat to his present posting on account of pending Rapat.

CRM-M-56605-2022 -2Notice of motion returnable for 20.12.2022. Mr. Amish Sharma, AAG, Punjab, accepts notice on behalf of respondent-State and on instructions from ASI Gurdial Singh, submits that needful shall be done within 10 days."

Learned State counsel, at the outset, on instructions from ASI Gurdial Singh, submits that investigating officer has filed cancellation report before trial court on 14.12.2022, thus, the present petition has become infructuous.

In view of statement of learned State counsel, no further order is required.

Dismissed as infructuous.
