(Oral) This is second petition by the petitioner under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail in case FIR No.83 dated 26.07.2019 under Sections 366-A, 506 IPC and Sections 6 and 12 POCSO Act and Section 3 SC/ST Act registered at Women Police Station, Rewari, the earlier petition having been dismissed as withdrawn vide order dated 04.07.2019 of this Court Learned State counsel, on instructions from ASI Kapila, states that trial in the case is at an advance stage, as all PWs have been examined in the case and the case is fixed for 17.01.2020 for examination of defence witnesses.

Criminal Misc. No. M-49357 of 2019 -2In view of the conceded position that all prosecution witnesses have been examined and the case is fixed for examination of defence witnesses, this Court is not inclined to entertain this petition. Accordingly, the present petition is dismissed. However, the trial Court shall make an endeavour to conclude the trial within three months from today, provided the petitioner does not hamper the trial in any manner.
