(ORAL) In the present case, the petitioner is seeking the release of his retiral benefits i.e. gratuity, leave encashment etc. Counsel for the petitioner states that the petitioner retired from the services of the respondents on 31.05.2018 and even after the expiry of six months, the respondent has not released the benefits of gratuity and leave encashment etc., which he is entitled for under Rules 28 and 29, which govern the service.

Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has served respondents with a legal notice on 31.10.2018 (Annexure P-8), which is still pending consideration with the respondent and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice. CWP-37821-2018 -2In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondent is directed to decide the legal notice dated 31.10.2018 (Annexure P-8) by passing a speaking order within a period of two months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to him within a period of next two months.

Present writ petition stands disposed of .
