NIDHI GUPTA, J. (ORAL) Prayer in this 2nd petition filed under Section 439 Cr.P.C. is for grant of regular bail to the petitioner in case FIR No. 194 dated 16.10.2022 registered under Section 354 IPC and Section 10 of the Protection of Children from Sexual Offences Act, 2012, at Police Station City Rupnagar, Disrict Rupnagar.

Learned counsel for the State has filed custody certificate dated 27.02.2024, which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 01 year, 04 months and 13 days.

After arguing for some time, when this Court is not inclined to grant bail to the petitioner, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition, at this stage. Permitte d to do so.

Dismissed as withdrawn, at this stage.
