**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present case, the petitioner is the widow of late Sh.Prem Singh, who retired as a Lineman while working with the respondents. She has approached this Court with a prayer that the daily wage service of the husband of the petitioner, which he rendered from 12.11.1980 till 04.10.1992 when his services were regularized, needs to be treated as a qualifying service for computing the pensionary benefits. It has been averred in the petition that only the service, which the husband of the petitioner rendered from 05.10.1992 till 31.01.2010, has been taken into account.

Counsel for the petitioner further states that for the relief which has been sought in the present writ petition, the petitioner has served respondents with a legal notice on 18.11.2018 (Annexure P-9), NARESH KUMAR 2018.12.24 17:54 I attest to the accuracy and integrity of this document Chandigarh

CWP-37713-2018 -2which is still pending consideration with the respondents and the petitioner will be satisfied, at this stage, in case a time bound direction is issued to the respondents to decide the said legal notice. In view of the request made, without expressing any opinion on the merits of the case and the claim being made by the petitioner, the respondents are directed to decide the legal notice dated 18.11.2018 (Annexure P-9) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. In case after the decision, it is found that the petitioner is entitled for any monetary benefit, the same shall also be released to her within a period of next three months.

Present writ petition stands disposed of .
