Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.205 dated 14.10.2018 under Sections 323, 324, 506, 148, 149 IPC (Sections 325 and 326 IPC added later on), registered at Police Station Kartarpur, District Jalandhar Rural. Notice of motion was issued. Learned State counsel appeared and contested the petition.

I have heard learned counsel for the petitioner as well as learned State counsel and have gone through the record. From the record, I find that present petitioner is named in the FIR as Tarsem. He is stated to be armed with datar and caused injury with reverse side of datar on the arm and back etc. As per learned State counsel, VINEET GULATI 2019.01.09 15:58 I attest to the accuracy and authenticity of this document Chandigarh

CRM No.M-61575 of 2018 -2five injuries have been given by the present petitioner and one of the injury has been declared as grievous and fall under Section 325 IPC. Co-accused has given grievous injury on the head which falls under Section 326 IPC. Keeping in view the facts and circumstances of the present case and in view of the fact that petitioner has caused so many injuries and has taken active participation in the commission of the offence, I find that petitioner is required for custodial interrogation. Weapon is also to be recovered. No ground is made out for grant of anticipatory bail to the petitioner.

Therefore, finding no merit in the present petition, the same is dismissed.
