Petitioner has filed this petition under Section 438 Cr.P.C. for grant of anticipatory bail in case FIR No.102 dated 09.10.2018 under Sections 302, 34 IPC and Section 27 of the Arms Act, registered at Police Station Kotwali, Nabha, District Patiala.

Notice of motion was issued. Learned State counsel as well as learned counsel for the complainant appeared and contested the petition. I have heard learned counsel for the parties as well as learned State counsel and have gone through the record. From the record, I find that FIR in the present case has been VINEET GULATI 2019.01.08 15:56 I attest to the accuracy and authenticity of this document Chandigarh registered on the basis of statement of Munish Verma. The present

CRM No.M-61517 of 2018 -2petitioner is named in the FIR. He raised lalkara that both, complainant and his father, should not be spared and then, Umesh brought his licenced pistol and fired in the chest of complainant's father and co-accused also inflicted injuries upon the complainant. Motive is also against the present petitioner. Keeping in view the facts and circumstances of the present case and in view of the fact that petitioner is named in the FIR and he took active participation in the commission of the offence, I find that no ground is made out for grant of anticipatory bail to him.

Therefore, finding no merit in the present petition, the same is dismissed.

However, nothing stated above, shall constitute my opinion on merits of the case.
