**** AJAY KUMAR MITTAL, J. (Oral) The petitioner has approached this Court under Articles 226/227 of the Constitution of India, seeking direction to respondent No.2 to immediately release goods of the petitioner, which are stated to be lying at ICD, Ballabhgarh. 2.

Mr. Saurabh Goel, Sr. Standing Counsel, has put in appearance on behalf of the respondents and produced the communications dated 19.12.2018 & 17.12.2018, addressed by the Deputy Commissioner of Customs, ICD Ballabhgarh - respondent No.2 to the petitioner. Both the communications are taken on record, subject to all just exceptions. It was stated that the provisional assessment of the Bills of Entry as per applicable PD Bond & Bank Guarantee has been allowed and the petitioner has been informed vide letter dated 17th December, 2018. 3.

In view of the above, learned counsel for the petitioner submitted that though, no such formal intimation has been received from the petitioner, however, keeping in view the statement of learned counsel for the respondents and documents placed on record, the present writ petition has been rendered infructuous and may be disposed of as such. Disposed of as infructuous. However, liberty is granted to the petitioner to move an application for revival of the present writ petition, in case something survives therein.
