(Oral) The substantive prayer made in the petition reads as under :- "Therefore, it is most respectfully prayed that necessary directions be issued to ld. JMIC, Chandigarh for expeditious & proper disposal of Application bearing no. CRL MISC 1230 of 2023 dated 31.05.2023, registered on 01.06.2023 (Annexure P-2) moved u/s 340

(1) Cr.P.C. 1973 for the act of perjury committed by respondent by furnishing false income affidavit under oath & declaration." Learned counsel for the petitioner has submitted that the application in question was filed on 31.05.2023 and is still pending adjudication before the concerned Court.

Keeping in view the nature of the prayer made, this Court does not deem it appropriate to call upon the respondent at this stage. Keeping in view the entirety of facts and circumstances of the case, the present petition is allowed to the extent that the trial Court is directed to decide the application dated 31.05.2023 expeditiously, in accordance with law. Ordered accordingly.
