JUSTICE SANDEEP MOUDGIL Present: Ms. Shivya Sehgal, Advocate, for the petitioner Mr. Rajiv Verma, DAG, Punjab --- SANDEEP MOUDGIL, J (ORAL) The jurisdiction of this Court has been invoked under Section 438 Cr.P.C., for grant of anticipatory bail to the petitioner in FIR No.64 dated 28.3.2021, under Sections 307, 323, 324, 148, 149, 506, 120-B IPC read with Section 25 of Arms Act, 1959, registered at Police Station Khanna City-2, Police District Khanna, District Ludhiana. 2.

Learned State counsel informs the Court that the petitioner has not joined the investigation, as was directed to join. 3.

This Court having perused the previous order sheets and could make out that on 29.11.2023, Coordinate Bench of this Court has stayed the arrest of the petitioner and thereafter that interim order continued till date.

Learned counsel for the petitioner would submit that there was no specific direction by the Coordinate Bench to join the petitioner for investigation. Hence, in view of that he could not join the investigation. But he is ready and willing to join in case the Court directs. CRM-M No.54517 of 2023 -25. Looking at the veracity and facts as well as previous order sheets available on the case file, it would be appetite to grant opportunity to the petitioner for joining the investigation, hence, the petitioner is directed to join the investigation within one week from today. In case of his joining, the Investigation Officer shall release him on bail on furnishing of personal/security bonds to his satisfaction. However, it is made clear that in case the petitioner fails to comply with the direction any further i.e. to join the investigation within one week, this order granting anticipatory bail shall automatically stands cancelled. The petitioner shall also abide by the terms and conditions as envisaged under Section 438(2) of Cr.P.C.
