(ORAL) Through this petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner, in a case, arising from FIR No.7 dated 09.01.2017, registered under Sections 18/25 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Sirhind, District Fatehgarh Sahib.

According to the prosecution, on 09.01.2017, 3.1/2 kg of opium was recovered from a car, in which, the petitioner and his accomplice namely Ravinder Singh @ Teenu were travelling. Learned counsel contends that alleged recovery from the petitioner and his co-accused falls under the category of "small quantity". The petitioner is in custody since 10.01.2017. Co-accused of petitioner aforesaid has already been granted the concession of regular SONIKA 2019.04.04 16:18 I attest to the accuracy and authenticity of this document Chandigarh

CRM-M-61924 of 2018 --2-- bail vide order dated 19.11.2018 passed by this Court in CRM-M24838-2018. Treating the case of the petitioner on same parity, he may also be granted the concession of regular bail. Conclusion of trial may take a sufficient long time. No useful purpose would be served by detaining the petitioner in jail any more during trial. Considering overall facts and circumstances, but without expressing any opinion on the merits of the case, the petition is allowed. Consequently, petitioner is ordered to be released on interim bail till conclusion of trial, on his furnishing bail bonds and surety bonds to the satisfaction of Trial Court/Duty Magistrate concerned. Disposed of.
