The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 -District Magistrate, Fazilka to send fresh verification report to respondent No. 5 - Dr. B.R.Ambedkar, National Institute of Technology, Jalandhar (Punjab). 2.

Petitioner was selected by respondent No. 5 for the post of Technical Assistant in the Department of Chemical Engineering. As per procedure, respondent No. 5 sought Character Verification report from District Magistrate, Fazilka who vide report dated 23.07.2024 reported that two FIRs are pending against the petitioner. CWP No. 28620 of 2024 -23.

Mr. G.S.Saini, Advocate submits that FIR No. 0133 dated 02.05.2020, under Sections 452, 323, 354, 148, 140 of Indian Penal Code, registered at Police Station Sadar Fazilka, District Fazilka stands set aside by this Court and police has filed cancellation report in FIR No. 0277 dated 10.10.2021, under Sections 447, 511, 427, 506 of Indian Penal Code, registered at Police Station Sadar Fazilka, District Fazilka. The jurisdictional Deputy Commissioner has ignored factual position and mechanically sent report to respondent No. 5. 4.

Mr. Dharminder S. Lamba, DAG, Punjab, on being pointed out aforesaid facts, submits that jurisdictional authority would re-look into the matter and send fresh report as per available record. 5.

In the wake of statement of learned State counsel, the instant petition stands disposed of. The needful shall be done within three weeks from today.
