Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner(s) in case FIR No. 99 dated 10.07.2017, registered under Section(s) 279, 427 & 337 IPC at Police Station Division No.4, Jalandhar.

Learned counsel for the petitioner contended that petitioner was earlier admitted to bail and had been regularly appearing before the learned trial Judge. However, on 02.06.2018, petitioner could not appear before the learned trial Judge as he had noted down the incorrect date and on that account, his bail was cancelled. Learned counsel further contended that petitioner had no reason not to appear before the learned trial Judge as he had been appearing regularly. More so, petitioner is ready to furnish fresh bail bonds before the learned trial Judge.

Criminal Misc. No. M-61650 of 2018 On asking of the Court, Mr. Sukhbeer Singh, Assistant Advocate General, Punjab accepts notice on behalf of respondent. A copy of paper-book be provided to him during the course of the day. In view of above, present petition stands disposed of with the directions that petitioner shall surrender before the learned trial Judge and on his doing so, the learned trial Court may admit him on fresh bail on his furnishing fresh bail bonds with two sureties to its satisfaction. However, the learned trial Judge shall be at liberty to complete the proceedings under Section 446 Cr.P.C. against the petitioner.
