ARUN MONGA, J. (Oral) Petitioner herein seeks issuance of a writ in the nature of mandamus directing respondent No.2 to decide the appeal dated 27.08.2019 (Annexure-P.8) filed by him before respondent No.2 within specific time period, which is pending before respondent No.2 from the last more than two months and the petitioner is going to retire from his government services in the month of May 2020.

Learned counsel for the petitioner states that the petitioner is compelled to approach this Court since the appeal dated 27.08.2019 HARPAL SINGH PARMAR 2019.11.28 09:45 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.33949 of 2019 [2] (Annexure-P.8) filed by him has not been entertained by the respondents till date.

On advance service of the petition, Mr. Mehardeep Singh, Assistant Advocate General, Punjab for the respondents appears and accepts notice on behalf of the respondents.

Given the nature of order being passed, there is no necessity to seek return by the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the writ petition is disposed of with a direction to the respondent No.2/competent authority to fix the appeal dated 27.08.2019 (Annexure-P.8) for an actual date of hearing and decide the same after affording an opportunity of being heard to the petitioner and pass an appropriate order, in accordance with law. 7.

Let the needful be done as expeditiously as possible preferably within a period of 3 months from the date of receipt of a certified copy of this order.
