(Oral) The challenge in this writ petition filed under Articles 226/227 of the Constitution of India, is to the order dated 04.12.2018 (Annexure P-4), passed by respondent No.2, vide which, the claim of the petitioner has been rejected in pursuance of order dated 02.11.2017 of respondent No.3 (Annexure P-1 Colly), which was set aside by the Hon'ble Haryana Tax Tribunal vide its order dated 28.11.2018 (Annexure P-2).

Learned State counsel has produced a copy of the order dated 09th January, 2019, passed by the Dy. Excise & Taxation Commissioner (ST), Sonepat, wherein, it has been recorded that the order dated 04th December, 2018 passed by the undersigned to give effect to order of the Jt. Excise & Taxation Commissioner (Appeal), Rohtak, has become infructuous, in view of the Tribunal's order dated 28.11.2018. The relevant part of the aforesaid order is reproduced as under:- "The legal position after the Hon'ble Tribunal order dated 28/11/2018 received on 14/12/2018 is that, since the order of Jt. Excise & Taxation Commissioner (Appeal), Rohtak dated 02/11/2017 has been quashed, the order dated 04/12/2018 of the JAWALA RAM 2019.01.18 12:45 I attest to the accuracy and authenticity of this document Chandigarh
CWP No. 37739 of 2018 - 2 - undersigned which was passed to give effect to order of Jt. Excise & Taxation Commissioner (Appeal), Rohtak, has become infructuous." The copy of the aforesaid order dated 09th January, 2019, is taken on record, subject to all just exceptions. Office to tag the same at the appropriate place.
