(Oral) The present petition has been filed by the petitioner under Section 439 Cr.P.C. for grant of regular bail to him in case FIR No.169 dated 06.10.2017 registered under Sections 406, 420 read with Section 120-B IPC with addition of Sections 419, 465, 467, 471 IPC at Police Station Kharar, District Mohali.

Learned counsel for the petitioner submits that earlier the petitioner filed Criminal Misc. No. M-28576 of 2018 before this Court and was released on regular bail vide order dated 24.08.2018 but he could not furnish bail bonds as sections 419, 465, 467, 471 IPC were added subsequently. The petitioner was not aware about addition of aforesaid sections. Challan has been presented after completion of investigation and nothing is to be recovered from the petitioner. The petitioner is ready to appear before the trial Court on each and every date and he is in custody since 21.05.2018.

Learned State counsel has not disputed the custody period; allowing of earlier petition by this Court and stage of trial as investigation has been completed.

Heard arguments of learned counsel for the petitioner as well as learned State counsel and have also perused the contents of the FIR and other documents available on the file.

By considering the submissions made by learned counsel for the petitioner that the petitioner is in custody since 21.05.2018; the fact that the investigation has been completed; earlier CRM-M No.28576 of 2018 filed by the petitioner was allowed by this Court on 24.08.2018 but he could not be released because of addition of Sections 419, 465, 467, 471 IPC; the trial may take long time to conclude and no purpose would be served by keeping the petitioner in custody, the present petition is allowed and the petitioner (Gulzar Singh) is directed to be released on regular bail subject to his furnishing bail/surety bonds to the satisfaction of the trial Court. 25.01.2019 (DAYA CHAUDHARY) neetu JUDGE Whether speaking/reasoned Yes Whether Reportable No NEETU RANI 2019.01.28 15:28 I attest to the accuracy and integrity of this document High Court Chandigarh
