On 29.08.2025 following order was passed by this Court:- "The present petition for grant of pre-arrest bail has been filed by petitioner-Anas Khan, an accused in FIR No.0011 dated 14.11.2024, registered against him for commission of offence punishable under Sections 318(4), 338, 336(3), 340(2) of BNS, 2023, at Police Station Economic Offences Wing, Chandigarh. Learned counsel submits that petitioner an Advocate by profession, had been legally advising M/s Biship Immigration SCO No.77, Sector 40-C, Chandigarh. One Gurjant Singh, intended to go abroad. Petitioner had disclosed to him about the above firm. Even legal advise was tendered by him (petitioner), though Gurjant Singh received an appointment for Visa with the
German Embassy but on account of some reason he was asked to again consult VFS Global. After visiting the Delhi office of above said firm, he was asked to sign certain documents, at which point in time, he had a talk with the petitioner. Further as per learned counsel, some issue arose between the firm and Gurjant. Unnecessarily however, petitioner, who had no concern absolutely in the business and day today running of the firm, received a notice, when he came to know that he has been implicated in a complaint lodged by Gurjant Singh. During the inquiry proceedings, further as per learned counsel, Gurjant Singh complainant, admitted that he had never filed any complaint against the above firm (M/s Biship Immigration). Despite this, police authorities, did not cancel the FIR.
Learned counsel submits that petitioner who has been falsely implicated is willing to join the investigation as and when called for by the Investigating Officer.
Notice of motion.
Mr. Viren Sibal, APP for U.T. Chandigarh, accepts notice on behalf of Union Territory, Chandigarh and seeks time to file detailed status report. Learned State counsel submits that several innocent persons have been duped by M/s Biship Immigration. Petitioner is the real brother of the Director of the firm and plays an active role in day today working.
