(ORAL) Through this second petition under Section 439 Cr.P.C. prayer has been made for grant of regular bail to the petitioner in a case arising from FIR No.92 dated 16.03.2018, registered under Sections 307, 302, 148, 149, 506, 120-B IPC and Section 25 of the Arms, 1959 at Police Station Bhupani, Faridabad (Haryana). According to the prosecution, petitioner is facing trial in aforesaid FIR on the allegation of murder of one Manoj. Learned counsel contends that petitioner was not named in the FIR. The material witnesses have turned hostile. The petitioner is in custody since 29.04.2018. Conclusion of trial may take a sufficient long time. On the other hand, learned State counsel has not been able to refute the submission of learned counsel for the petitioner that material witnesses have turned hostile.

Having given thoughtful consideration to the rival submission and that conclusion of trial may take sufficient long time, but without commenting on the merits of the case, the petition is allowed.
