The petitioner has approached this Court seeking grant of regular bail in respect of a case registered vide FIR No.115 dated 4.8.2019 at Police Station Division No.5, Jalandhar under Sections 379-B and 34 of Indian Penal Code.

The FIR was lodged at the instance of Kanav Khanna, wherein it has been alleged that on 31.7.2019 when his wife was returning home from Gym, then two motorcycle borne persons came there and snatched gold chain worn by his wife stated to be valued at about `45,000/-. 3.

The learned counsel for the petitioner has submitted that he is not named in the FIR and has been nominated as an accused on the basis of his own PANKAJ KAKKAR 2020.02.14 17:22 I attest to the accuracy and integrity of this document

Opposing the petition, the learned State counsel has submitted that since it is a case where pursuant to disclosure statement made by the petitioner, recovery of gold chain of complainant's wife was also recovered, no case for grant of bail is made out.

Without commenting anything on merits of the case and while keeping in view the fact that the petitioner has been behind bars since the last about 5 months and that challan already stands presented, further detention of the petitioner would not serve any useful purpose as the conclusion of trial is likely to take some time.

The petition, as such, is accepted and it is ordered that the petitioner be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
