"The petitioner through instant petition under Article 226 of Constitution of India is seeking writ in the nature of habeas corpus for the release of detenues, as mentioned in paragraph No.2 of the petition from the illegal and unlawful custody of brick kiln's owner.
Notice of motion.
Ms. Dimple Jain, AAG, Haryana, accepts notice on behalf of the State.
Copy of paper-book has been supplied to learned State counsel.
Adjourned to 23.12.2022.
Let a status report of SDM, Panipat be filed before the adjourned date."
In compliance of above order, the State has filed status report by way of affidavit of Virender Singh Dhull, Sub-Divisional Magistrate, Panipat. The affidavit is taken on record and Registry is directed to tag at appropriate place.
The perusal of affidavit discloses that petitioner and his family members had already returned to their home two days back. It further discloses that brick kiln in question is located in a different village and it is lying almost close.
