*** Learned counsel for the respondent states that in terms of the compromise the parties have filed a petition under Section 13B of the Hindu Marriage Act in the Court of competent jurisdiction at Patahankot where their statements have been recorded on first motion. He states that the respondent would withdraw the petition under Section 9 of the Hindu Marriage Act from the trial Court in view of the compromise.

There is no representation on behalf of the applicant. Similar was the position on the previous two dates of hearing. Under the circumstances, it seems that the applicant does not want to prosecute the application in view of the compromise arrived at between the parties, as stated by learned counsel for the respondent, therefore, the application is dismissed for non-prosecution.
