(ORAL) Through instant petition under Section 438 of Code of Criminal Procedure, 1973, the petitioner is seeking setting aside of impugned order dated 11.11.2022 whereby ASJ, Gurugram has granted concession of anticipatory bail to respondent No. 2 in FIR No. 301 dated 15.09.2022, under Sections 376(2)(n) and 506 IPC, registered at Police Station Sector-53, Gurugram. Learned State counsel, at the outset, submits that challan stands presented, thus the present petition has rendered infructuous. On being confronted with this fact, learned counsel for the petitioner expressed his inability to controvert. In view of the above, the instant petition is dismissed as having been rendered infructuous.
